The German consumer contract system has one feature most expats never learn about: the Sonderkündigungsrecht. It lets you exit a fixed-term contract early — with just 2 weeks notice — when you permanently leave the country. A 24-month phone contract entered into 10 months ago? Cancellable. A gym membership that runs another 18 months? Cancellable. The proof is your Abmeldebestätigung. Most providers accept it without pushback.

Do not close the bank account first:

If you close your German bank account before cancelling SEPA contracts, the debit bounces and gets sent to a collection agency. Cancel all direct debits and active contracts before or simultaneously with closing your bank account.

What is the Sonderkündigungsrecht?

The Sonderkündigungsrecht (extraordinary termination right) lets you exit a German contract early — without the standard notice period — when there is a significant change in circumstances that you cannot reasonably be expected to have foreseen. Moving abroad permanently qualifies for most consumer contracts under §314 BGB and §626 BGB. This means you can exit a 24-month phone contract 10 months early, or leave a gym contract 14 months before it would normally expire, by proving you are leaving Germany. The proof is your Abmeldebestätigung.

What proof do I need to use the Sonderkündigungsrecht?

Your Abmeldebestätigung (the deregistration certificate from the Bürgeramt) is the standard evidence that German providers accept. Send a copy alongside the cancellation letter. Some providers also accept a copy of your new foreign address registration (Ummeldebescheinigung from your new country) or a rental contract for your new address. Do not send original documents — copies or certified copies only.

Does the Sonderkündigungsrecht apply to all German contracts?

Most consumer contracts, yes. Mobile / SIM contracts, home internet (DSL / cable), gym memberships, subscription media services with a contract term, and household insurance: all standard candidates for Sonderkündigung. Insurance for risk products (Haftpflicht, Hausrat, Kfz) has separate termination rules — typically you can cancel on the contract anniversary or after a claim. Health insurance (gesetzliche Krankenversicherung) is terminated separately via your employer or directly with the Krankenkasse when your statutory insurance obligation ends.

How much notice do I still need to give?

Even with Sonderkündigungsrecht, you must give a reasonable notice period — typically 2 weeks for most consumer contracts. Some providers specify the notice period in their AGB (terms and conditions); 14 days is the most common. The cancellation takes effect from the date of your move-out or from the date the provider receives notice, whichever is later and reasonable. We specify this clearly in each template.

What if the provider refuses the Sonderkündigung?

This happens, but not often for documented international moves with an Abmeldebestätigung. If they reject it: (1) send a formal Nachfrist (deadline for compliance) citing §314 BGB; (2) escalate to the Verbraucherzentrale (consumer advisory centre) in your last German state, which offers free advice to expats too; (3) file a Schlichtung (ombudsman procedure) — all German telecom providers are required by law to participate. We include escalation guidance in the template notes.

Can you send the cancellation letters for me?

Yes — under the Residence Deregistration All-Inclusive package (EUR 199.90), we include contract cancellations as part of the full exit service. What about my German health insurance?

Gesetzliche Krankenversicherung (statutory health insurance via a Krankenkasse) is terminated when your mandatory insurance obligation ends — this is tied to your employment, not your address. Your employer should notify the Krankenkasse when you leave. If you were voluntarily insured (freiwillig versichert), you can terminate with 2 months' notice from the end of the month you became a non-German resident. Private Krankenversicherung (PKV) has specific cancellation rules tied to the premium adjustment cycle. We do not cover health insurance termination in the template tool — the rules are too varied. Contact your Krankenkasse directly.

My contract has a Mindestvertragslaufzeit (minimum contract term) that ends in 3 months. Should I use the Sonderkündigungsrecht or wait?

If the minimum term ends within 3 months, wait and cancel normally. The Sonderkündigungsrecht is most valuable when you have a long time remaining on the contract. For a contract expiring in 3 months, the normal termination with the standard notice period (usually 30 or 90 days depending on the contract) is simpler and carries less risk of a provider dispute.

I already left Germany. Can I still cancel from abroad?

Yes. Cancellation letters can be sent from any address — the provider only needs to receive them. Use registered mail (Einschreiben) or email if the provider accepts it (look for a Kündigungsadresse in the contract or on their website). Include your Abmeldebestätigung, your current address abroad, and a copy of your ID. We include a template with the correct format for each contract type.
